Maryland proposed legislation imposing a tax on every single bank operating in Maryland which is not chartered by the state of Maryland. The statute said that all backs were prohibited from issuing bank notes except on stamped paper issued by the state of Maryland, there were fees and penalties for violators. The issues were proposed: Does Maryland have the sufficient power under the Constitution to create a separate and distinct legal entity, though the specific power is not listed in the constitution? Does Maryland have the sufficient power to tax a business that was created by Congress pursuant to its power under the Constitution? "Yes. Congress has power under the Constitution to incorporate a bank pursuant to the Necessary and Proper clause (Article I, section 8). No. The State of Maryland does not have the power to tax an institution created by Congress pursuant to its powers under the Constitution." -Lawnix.com "The Bank of the United States has a right to establish its branches within any state.
